Bart Reagor, Reagor Auto Mall claim First Bank & Trust party at fault

Reagor Auto Mall and co-owner Bart Reagor admit the Auto Mall has defaulted on payments demanded to First Bank & Trust, but claim the bank is partly at fault.

First Bank & Trust sued Reagor Auto Mall d/b/a Reagor-Dykes of Levelland and d/b/a Reagor Dykes Imports, FirstCapital Bank, Bart Reagor, Rick Dykes, former Reagor-Dykes CFO Shane Smith, former Reagor-Dykes controller Sheila Miller, First Capital Bank CEO Brad Burgess and First Capital Bank Chairman Kenneth Burgess. The suit has been moved to federal court. FirstCapital has filed a motion to dismiss and a counterclaim in this lawsuit.

Reagor Auto Mall includes the Levelland dealership and Reagor Dykes Imports. This company has not filed for bankruptcy.

It its amended complaint, First Bank & Trust claims some of its collateral at these dealerships has been sold, is missing or has been double pledged. The bank claims the amount owed for these 21 vehicles is more than $420,000.

In their responses, both Bart Reagor and the Reagor Auto Mall claim the bank improperly impaired the value of the security for these claims, allowing the dealership to set off the amount of any such impairment.
 
They also claim First Bank & Trust engaged in conduct with former Reagor-Dykes chief financial officer Shane Smith that damaged its ability to pay.

Both Reagor and the Auto Mall indicate they are too wrapped up in restructuring the company to fully investigate the matter. And, both write they reserve the right to counter-claim.

A judge's order from Oct. 15 states U.S. Marshals will take possession of vehicles with a procedure in place to ensure First Bank & Trust and FirstCapital Bank are paid properly. This order goes into effect Monday, Oct. 29. If the Auto Mall joins the Chapter 11 filing, this order will end and all vehicles involved would become part of the bankruptcy estate.
