Compromise on vehicles in First Bank & Trust lawsuit v. Reagor Auto Mall

LUBBOCK, Texas -

In U.S. District Court, there is a compromise in the First Bank & Trust lawsuit against Reagor Auto Mall, FirstCapital Bank and several others.

Representatives for Reagor Auto Mall admit it has defaulted on loans, according to a judge's order filed Monday. This entitles both First Bank & Trust and FirstCapital to take possession of vehicles. Both banks have agreed to postpone repossession for two weeks. 

The judge's order, posted as a pdf below, indicates U.S. Marshals will take possession with a specific procedure in place for a vehicle to be sold, so the appropriate bank is paid.

This suit involves Reagor Auto Mall, which has not filed for bankruptcy. The dealerships involved are in Levelland and Reagor-Dykes Imports in Lubbock.

If the Auto Mall joins the chapter 11 filing, this order will end and all vehicles involved would become part of the bankruptcy estate.
